Terms of service

The service

wemakeit.app provides two tools: a GIF converter and a sticker pack maker for WhatsApp and Discord. Both tools are free to use, require no account, and process files server-side before deleting them on an automated schedule.

We reserve the right to modify, suspend, or discontinue any part of the service at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.

Your use of the service

You may use wemakeit.app only for lawful purposes and only in accordance with these terms.

You must not upload content that:

• Sexually exploits or depicts minors in any way. This is an absolute prohibition. We reserve the right to screen uploaded files against known child sexual abuse material (CSAM) hash databases, and we will report any CSAM we become aware of to the National Center for Missing and Exploited Children (NCMEC) and cooperate with relevant law enforcement.
• Infringes any copyright, trademark, patent, trade secret, or other intellectual property right of any person or entity.
• Violates the privacy or publicity rights of any person, including by uploading images or video of individuals who have not consented to publication.
• Contains malware, viruses, or any code designed to harm or interfere with computer systems or networks.
• Is defamatory, harassing, threatening, obscene (except lawful adult content not otherwise prohibited), or otherwise unlawful under applicable law.
• You do not have the right to use, reproduce, or distribute.

You must not use the service to:

• Circumvent, disable, or interfere with any security or rate-limiting feature.
• Automate requests to the service in a way that places an unreasonable load on our infrastructure.
• Reverse engineer, decompile, or disassemble any part of the service.
• Misrepresent your identity or the origin of files you upload.

Intellectual property

You retain all ownership rights in the files you upload and the output you download. By uploading a file, you grant us a limited, non-exclusive, royalty-free license to process it for the sole purpose of producing the output you requested. This license terminates automatically when the file is deleted.

All other content on wemakeit.app, including the website design, code, text, and graphics, is owned by or licensed to wemakeit.app and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the site without our prior written permission.

File deletion and availability

Files are deleted automatically: GIF source files and output within one hour of creation; sticker pack files when the seven-day link expires. We do not guarantee that files will be available for download for the full duration of these windows. Once deleted, files cannot be recovered. You are responsible for saving your output before the deletion window closes.

Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, wemakeit.app AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM (WHICH FOR A FREE SERVICE IS $0) OR (B) $100 USD.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In those jurisdictions, our liability is limited to the fullest extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless wemakeit.app and its operators from any claim, demand, loss, liability, or expense (including attorneys' fees) arising out of or related to your use of the service, your uploaded content, or your violation of these terms or any applicable law.

DMCA and copyright complaints

We respect intellectual property rights. If you believe content processed through our service infringes your copyright, see our DMCA policy for instructions on how to submit a valid takedown notice under 17 U.S.C. § 512.

Governing law and disputes

These terms are governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions. Any dispute arising out of or relating to these terms or the service shall be resolved exclusively in the courts of Tel Aviv, Israel.

If you are a consumer in the EEA, you may also have access to out-of-court dispute resolution through your national consumer protection body or the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Changes to these terms

We may update these terms at any time. We will update the "Last updated" date above. Continued use of the service after an update constitutes acceptance of the revised terms. If you do not agree to the updated terms, stop using the service.
